Dear Mr Henney,

Thank you for you letters of 5th and 6th of May, which largely repeat points you have made earlier. I see little point in a literary exchange programme with you and other EMAG associates who have written to the Society recently to the same effect.

To confirm:

  • As you have been told previously, the Society's legal advice is privileged and will not be released to external parties.
  • As you admit, your website provides links to groups which are threatening to sue the Society. Providing a link would be regarded by most rational commentators as advertising and therefore promoting that organisation.
  • The Board has allowed Resolution 5 to go forward to allow continuing members to have their say on funding EMAG. It is keen to hear representative views on this matter. We will know the outcome of the vote on May 19.
For some time now, we have been encouraging the Parliamentary Ombudsman to re-open her enquiry and working quietly with the appropriate people to secure that, if at all possible. We have not seen the need to follow a costly legal route to achieve this objective and much of our activity in this area is being undertaken without fanfare.

I have discussed our correspondence and EMAG's requests fully with the Board. It sees no reason to change its view.
