19th November, 2003

Dear Mr Plant,

In the matters of Equitable Life and Ernst & Young and 15 former directors:

Subsequent to the case review day in court on October 17th, on behalf of EMAG and all Equitable Life policyholders present and past, I wrote within the week to the Honourable Mr Justice Langley. That letter was delayed by the post dispute.

The Judge's personal response was to request that I forward my letter to all legal parties for consideration and response. To that end I was supplied with your contact details. As you will see, my written request was for a categorical undertaking that ALL the witness statements required to be lodged in court by January 30th, 2003, to be placed immediately thereafter in the public domain, in the public interest as well as the interests of policyholders

Perhaps you could also be so kind as to copy your reply to Peter Lane, Clerk to the Mr Justice Langley? Thank you.

Yours sincerely,

Paul Braithwaite
General secretary, EMAG
